Michael S. Weinstein serves as Chair of the firm’s nationwide White Collar Litigation & Government Investigations Practice. He is a former trial attorney and federal prosecutor with both the U.S. Department of Justice and U.S. Attorney’s Office in Washington D.C. He is called upon in the most demanding of situations to navigate and rebuff damaging civil, criminal or regulatory allegations from private litigants to government agencies, such as the U.S. Department of Justice, state attorney generals, FBI, Securities & Exchange Commission, FINRA and local government agencies as well as private, public and quasi-public corporations.

Each dispute, whether civil or criminal, can and often does bring with it significant personal, professional and financial consequences that require tactical considerations, strategic litigation, discretion, zeal and often aggressive advocacy. Michael appreciates that how to act as well as when to execute on a broader litigation strategy are equally important. He counsels clients from the earliest stage of government inquiries through investigations, testimony, discovery and ultimately trial. Michael provides forward thinking client advice in evaluating potential legal risks, assessing litigation options and executing on overall strategy. His approach ensures a focused, comprehensive strategy consistent with client objectives.

With broad courtroom experience in white collar matters, Michael is regularly retained as lead trial counsel in high stakes civil litigation and arbitrations in courts across the country. His diverse range of civil litigation experience includes corporate disputes, breach of contracts, construction, negligence, intellectual property and fraud actions. His lengthy trial and investigative experience serves as the backbone to each matter.

Board of directors, audit committees and senior management from varying industries routinely engage Michael to conduct internal investigations. These investigations often involve allegations of fraud, executive misconduct, criminal activities and breach of internal or regulatory policies and procedures. Most recently, Michael handled a series of investigations including retention by one of the world’s largest shopping mall developers, a global pharmaceutical company and a corporate malfeasance and misappropriation of company assets for a publicly listed global apparel company.

Michael serves as an appointed Independent Monitor for various New York City construction services companies. He was awarded broad discretion to investigate and provide oversight with ongoing company financial affairs, safety, regulatory compliance and ongoing satisfaction with settlement terms.

Michael is an ongoing legal commentator and the author of numerous articles on high profile criminal defense and business litigation topics. He regularly appears on broadcast and cable television (NBC News, CNN, Fox, BBC, NPR), in leading newspapers (Wall Street Journal, New York Times, The Washington Post and Los Angeles Times), and online sites such as Politico, Associated Press Bloomberg.

While at the Department of Justice, Michael was awarded the prestigious Pegasus Trust Fellowship in London, England. He earned his law degree from American University Washington College of Law and his B.A. in Criminal Justice from American University in Washington D.C.
