Employers rely on restrictive covenants and other provisions to protect their confidential and proprietary information, trade secrets and customer relationships. This webinar will examine the various types of covenants, including non-compete, non-solicitation, non-interference, and nondisclosure and confidentiality clauses, and will discuss the legitimate business interests that support enforceable covenants. The speakers will address issues to be considered in drafting restrictive covenants, as well as those that arise when employers seek to enforce such covenants in New Jersey and New York courts, including balancing of employer and employee interests, tolling provisions, and “blue penciling” or partial enforcement of covenants.
